2.- Acceptance
The Service is available to any user for their own use and is subject to the following terms and conditions: these Terms of Use and Contract, our Privacy Policy, and our Cookie Policy, which are always available at the bottom of the website. The Service may not be used for illegal purposes or in any way other than as expressly stated herein.
3.- Applicable Regulations
Positio undertakes to ensure compliance with all applicable legal, regulatory, and administrative provisions pertaining to the subject matter and execution of this contract, including, but not limited to, mandatory national, European, and international legal provisions. Furthermore, it undertakes to act in accordance with the principles of legality, good faith, and contractual loyalty, adopting the necessary measures to ensure compliance with legal obligations at all times.
4.- Service Description
Through the Service, Positio offers an SEO optimization tool called “SEO Meta Optimizer” (hereinafter, the “Plugin” or the “Tool”), a WordPress plugin that generates and optimizes SEO meta tags (titles, meta descriptions, and keywords) for website content using artificial intelligence technology.
The Service operates on a credit system (called “requests”). Users purchase request packages through the website clientes.positio.es , which allow them to generate AI-optimized meta tags for pages, posts, products, or other content on their WordPress website.
The process for subscribing to and using the Service is as follows:
– Step 1: Package Selection. The user selects the SEO request package they wish to purchase (based on the number of requests needed) and adds it to the shopping cart.
– Step 2: Registration and Billing Information. Upon clicking “Checkout,” the user must complete the form with their personal and billing information (email address, first name, last name, company [optional], postal address, city, province, postal code, country, and phone number [optional]).
– Step 3: Payment. The user selects the available payment method and pays for the selected package.
– Step 4: License Receipt. Once payment is confirmed, the user will receive a unique license key associated with their account. This license can be viewed at any time in the “My SEO Licenses” section of their user account, where they can also check the number of remaining and used requests.
– Step 5: Plugin Activation. The user enters the license key into the SEO Meta Optimizer plugin installed on their WordPress site, linking it to the corresponding domain.
– Step 6: Using the Service. From the plugin, the user uploads their website content (pages, posts, products, etc.), selects the elements they wish to optimize, and generates the meta tags using AI. Each generation consumes one request from the available balance. The user can review and compare the results with previous data and apply any suggestions they deem appropriate.
Furthermore, please note that for legal reasons, we archive the electronic documents formalizing your purchases in your user profile. You can access these documents at any time in the “Orders” section of your account or by requesting them at the email address: hola@positio.es
In this regard, as a user of the Service, you agree to receive invoices for your purchases electronically. Once a purchase is made, you will receive an email with your order confirmation and license details. Your invoice and order history will always be available in your user profile. In any case, we can send you a paper invoice upon request to the address you provide. For more information, please contact us at hola@positio.es.
Likewise, during the purchase process, you can also modify your selected request package and payment method. To do so, click the back button when available and before finalizing your purchase.
5.- External Links
The Service may direct you to other websites via links. However, the Service does not control these sites or their content, which are subject to their own terms and conditions. Therefore, the Service is not responsible for the quality, truthfulness, or accuracy of these sites.
6.- Age
Regarding the use of the website, you represent that you are of legal age and have the legal capacity to be bound by this agreement and to use the site in accordance with its terms and conditions, which you fully understand and acknowledge.
You represent that all information you provide to access the Service, both before and during its use, is true, complete, and accurate.
7.- Intellectual and Industrial Property
7.1.- Proprietary Content
The content and information of the Service (including, but not limited to , text, sound, video, images, computer code, algorithms, and artificial intelligence models), as well as the infrastructure used to provide such content and information, are the property of the Service or are used with the corresponding authorizations.
Furthermore, no intellectual or industrial property rights are transferred to the client over the website, the Plugin, or any of its constituent elements. The reproduction, transformation, distribution, public communication, making available, extraction, reuse, forwarding, reverse engineering, decompilation, or use of any kind, by any means or procedure, of any of these elements is expressly prohibited, except where legally permitted or authorized by the holder of the corresponding rights.
For any other use of the Service’s content, you need our prior written consent.
7.2- Content Generated by the Service
The meta tags and SEO content generated by the Tool using artificial intelligence from user content will be freely usable by the user who generated them, exclusively for use on the website linked to the active license.
Positio does not claim intellectual property rights over the content generated by the Tool at the user’s request. However, Positio does not guarantee the originality or absence of similarities with third-party content in the AI-generated meta tags; it is the user’s responsibility to review them before final publication.
7.3.- User Content
As a user, you can contribute to the Service in various ways, such as sending emails or submitting suggestions (hereinafter “Content”).
We may use that Content in various ways, for example, displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting errors, creating derivative works from it, promoting it, and distributing it.
Therefore, the Content remains your property, but by submitting it, you grant the Service a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use that Content until the content is removed.
8.- License and Credit System
Purchasing a request pack grants the user a non-exclusive, non-transferable, and revocable license to use the SEO Meta Optimizer Plugin on the web domain linked to the provided license key.
Each license is associated with a single domain. If the user wishes to use the Plugin on a different domain, they must deactivate the license for the current domain from within the Plugin and activate it on the new domain. Changing domains does not result in the loss of any remaining requests.
Purchased requests do not expire as long as the user’s account remains active. Each request is consumed when generating SEO meta tags (title, meta description, and keywords) for specific content. The user can check their remaining request balance at any time in the “My SEO Licenses” section of their user account and in the “License” tab of the Plugin.
Requests are cumulative: if the user purchases a new pack before exhausting the requests in a previous pack, the remaining requests will be added to the new balance.
9.- Digital Product Delivery and Availability
As this is digital content, the license and associated credits are delivered immediately upon payment confirmation. The user will receive an email confirming the order and their license key, and can also access this information at any time in the “My SEO Licenses” section of their user profile.
The Service is committed to maintaining the availability of the platform and the Plugin under normal operating conditions. In the event of scheduled maintenance interruptions, the user will be informed as far in advance as possible.
10.- Price and Taxes
The prices of the offered request packages are listed in euros (€), including Value Added Tax (VAT) valid at the time of purchase.
However, the transaction may be exempt from or not subject to VAT depending on your country of residence or your tax status. Therefore, in some cases, the final price of the order may differ from the price shown.
The price of the products or services will be as stated on the website at any given time, except in cases of obvious error. Although we strive to ensure that all prices on the website are correct, errors may occur.

11.- Shipping Costs
As these are digital products (software licenses and usage credits), shipping costs do not apply. Delivery is made exclusively electronically through automatic license activation in the user’s account.
12.- Payment Method
Online payment for request packages must be made in full in advance. Accepted payment methods will be those available at the time of purchase on the payment gateway at clientes.positio.es.
In this regard, the Service informs users that transactions on the platform are carried out through a secure payment gateway, using TLS technology to guarantee the security of data transmission.

13.- Plugin Access and Use
Access to the Plugin and purchased credits is linked to the user’s account credentials on the platform and the provided license key.
– The user is responsible for maintaining the confidentiality of their access credentials and license key. Any activity performed through their account or license will be the responsibility of the account holder.
– Redistribution, resale, transfer to third parties, or sharing of the license key without prior written authorization from the Service is prohibited.
– The user agrees not to use the Plugin to generate illegal, deceptive, defamatory, or infringing content.
– The user may not reverse engineer, decompile, modify, copy, or create derivative works of the Plugin.
14.- Right of Withdrawal, Cancellation, Returns, and Refunds
14.1.- Right of Withdrawal
You can cancel your order at any time and at no cost, provided you notify us before the license has been activated or any requests have been processed.
Pursuant to Article 103.m) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users (LGDCU), the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium when performance has begun with the consumer’s prior express consent and with the understanding that they will consequently lose their right of withdrawal.
Therefore, by confirming the purchase and receiving the license key, the user expressly consents to the immediate execution of the contract and acknowledges that they lose their right of withdrawal once the license is activated in the Plugin or the first request has been used.
Notwithstanding the foregoing, if for technical reasons you are unable to activate the license or use the Service, you may contact us at the email address: hola@positio.es so that we can resolve the issue.
14.2- Account Cancellation
The user may request account cancellation at any time by writing to hola@positio.es. Account cancellation will result in the deactivation of the active license and the loss of any remaining unused requests, without the right to a refund.
Positio also reserves the right to suspend or cancel a user’s account in the event of a breach of these Terms, fraudulent use of the Service, or any other conduct that may harm the normal operation of the platform or the rights of third parties, after notifying the user, except in duly justified cases of emergency.
14.3.- Returns and Refunds
If the Service is unable to resolve a technical issue preventing the user from using the purchased license, and no requests have been used, a full refund will be issued within 14 calendar days using the same payment method used for the initial transaction.
Refunds will not be issued if the user has used all or part of the requests included in the purchased package, except in the cases of non-conformity described in the following section.
14.4.- Digital Content Warranty
As the service provider, Positio will be liable for any lack of conformity in the digital content that becomes apparent within two (2) years of delivery. A lack of conformity will be considered to include, among other things, the Plugin not functioning as described, the generation of meta tags not being executed correctly, or requests being consumed without returning any results due to a cause attributable to the Service.
In such cases, the user may request that the Service remedy the lack of conformity by restoring the improperly consumed requests or, if this is not possible, terminate the contract with a proportional refund of the price paid.
To exercise this right, the user must inform the Service of the lack of conformity, taking into account the moment they became aware of it.

15.- Validity of Offers
The request packages offered on the Service and their prices will be available for purchase while they are published on the platform.
In any case, the Service reserves the right to make any modifications it deems appropriate, and may update packages, prices, and services according to market conditions.
The Service reserves the right to change prices without prior notice. Price changes will not affect requests already purchased.
Please note that despite updates to the Service’s prices, they may contain errors. We will promptly correct any errors that appear, but they will not be binding on the Service.
Likewise, the Service may, at its sole discretion, create promotional codes that can be redeemed for products or as a discount on the price of packages purchased by the user, subject to these conditions or any additional conditions that the Service may establish specifically for each promotional code.
By using promotional codes, you agree that:
– They must only be used for the intended purpose and in a lawful manner.
– They may not be duplicated, sold, or transferred in any way, or made available to the general public (whether posted on a public forum or otherwise), unless with the Service’s permission.
– They may be invalidated by the Service if any breach or fraud is detected in their use.
– They may only be used in accordance with the specific conditions established by the Service for that promotional code.
– Depending on the terms of the code, they may expire before you can use them.
16.- Service Ratings
Users may rate the Service received through the platform or through the channels that Positio provides for this purpose.
Users agree to provide these ratings and comments truthfully and respectfully, and to refer to a service they have actually used. The company reserves the right to review or remove any ratings and comments that do not comply with these conditions.
The user acknowledges and accepts that the published ratings may be used by the company for informational, statistical, or promotional purposes, always guaranteeing respect for users’ rights in accordance with applicable data protection regulations.
17.- Security
As previously stated, the entire purchase process, including the transmission of your personal data and payment systems, is carried out on a secure page and encrypted using the TLS protocol.
We guarantee the security of the Service in accordance with current technological knowledge. However, the Service cannot guarantee its complete future security. In any case, we are committed to addressing and implementing appropriate corrective measures to address any potential security breach as soon as possible.
You agree to notify the Service immediately, via email at hola@positio.es, of any situation that could lead to the impersonation of a user or the unauthorized use of a license key.
18.- Exclusion of Warranties and Liability
The Service will exercise due diligence in providing the Service, including the accuracy, completeness, and timeliness of the content, as well as the availability and continuity of the Service’s operation.
In any case, the user understands that:
– Since the meta tag generation system is based on artificial intelligence technology, the generated results are indicative suggestions that should be reviewed by the user before application. Positio does not guarantee that the generated meta tags will be optimal for the user’s website SEO or that they will produce a specific result in terms of traffic or search engine ranking.
– The Service will endeavor to provide sufficient advance notice of any interruptions that may occur in the Service’s operation.
– Positio will not be liable for any damages or losses that may arise from the user’s application of the meta tags generated by the Tool, nor for the consequences that such application may have on the user’s website’s ranking, visibility, or reputation.
– The Service will not be responsible for the incompatibility of the Plugin with specific configurations of the user’s WordPress environment (themes, other plugins, PHP or WordPress versions, server configurations) that do not meet the minimum technical requirements communicated.
19.- Use of Artificial Intelligence
The user is informed and accepts that the Service uses artificial intelligence technology to generate SEO meta tags. The user’s website content is processed by the AI system solely for the purpose of generating the requested meta tag suggestions.
Positio agrees not to use the user’s website content for purposes other than providing the contracted Service, except in aggregated and anonymized form for the purpose of improving the Service itself.
The user acknowledges that the results generated by AI are probabilistic in nature and may vary depending on the content analyzed, and therefore should always review and validate the suggestions before applying them.
20.- Modifications and Severability
We may update the Service’s terms and conditions in the future, as well as the Service’s features and functions.
We will notify you of any changes to the terms and conditions by posting a notice prominently on our website and/or by email.
If any clause included in these terms and conditions is declared, in whole or in part, null or ineffective, it will only affect that provision or the part thereof that is null or ineffective. The terms and conditions will remain in full force and effect in all other respects, and such provision, or the affected part thereof, will be deemed not to have been included.
21.- Claims and actions arising from the contract
In the event of a dispute, this Service is subject to the laws and courts of the consumer’s domicile.
If the party contracting the Service does not qualify as a consumer, in the event of a dispute, the parties submit to the courts of Llanera (Asturias) and Spanish law.
22.- Languages of the texts
The following terms and conditions are presented in Spanish. In the event that versions are offered in other languages and there is a contradiction between the different versions, the Spanish version shall prevail.
